Introduction

White Moth Studio (“we,” “us,” “our”) provides photography services, digital products, and website content subject to the following Terms & Conditions (“Terms”). By accessing our website, booking a session, or purchasing any product or service, you (“Client,” “you,” “your”) agree to be bound by these Terms.


These Terms apply to all services provided in the State of Washington.




1. Definitions

Services: All photography, creative, digital, or consulting services provided by White Moth Studio.

Booking: A confirmed reservation secured with a required retainer payment.

Retainer: A non-refundable fee collected to secure a session date.

Deliverables: Final edited images, prints, albums, digital files, or other works created by us.

Contract: Any signed agreement or digital acceptance outlining the specific details of your session.




2. Booking, Payments & Fees


2.1 Retainer

A non-refundable retainer of $250 is required to secure your session date. No date is confirmed until the retainer is received.


2.2 Remaining Balance

The remaining balance is due on the session date or prior to the session date. Late payment may result in cancellation of your session without refund of the retainer.


2.3 Accepted Payment Methods

We accept digital payments, bank transfers, and other methods indicated on our booking page.


2.4 Pricing Changes

Rates are subject to change at any time but will not affect confirmed bookings.




3. Cancelling & Rescheduling


3.1 Cancellation by Client

Cancellation more than 72 hours before the session: Retainer is non-refundable; no additional fees.

Cancellation within 48 hours before session: Client is responsible for 100% of the remaining balance.


3.2. Rescheduling by Client

Clients may reschedule one time with at least 7 day written notice.

Additional reschedules or reschedules with insufficient notice will incur a fee of $150.


3.3 Cancellation or Rescheduling by Photographer

In cases of illness, emergency, equipment failure, or circumstances beyond our control, we will offer an alternative date or issue a refund of all payments made. This is the limit of our liability.




4. Client Responsibilities


4.1 Timeliness

Late arrivals reduce session time and will not result in discounts or extensions.


4.2 Preparation

Client is responsible for arriving with hair, makeup, wardrobe, and props as discussed unless additional services have been purchased.


4.3 Behavior & Safety

Client and participants must behave respectfully and follow all safety instructions. We may end a session early if safety concerns arise.


4.4 Location Permissions

Client must secure required permits for private or restricted locations. Any associated fees are the Client’s responsibility.




5. Photographer Responsibilities


5.1 Professional Conduct

We will provide services with reasonable skill, care, and artistic judgment consistent with our brand style.


5.2 Backup Preparedness

We maintain professional-grade equipment and backup systems, but liability is limited as outlined in Section 12.


5.3 Staff & Assistants

Photographer is responsible for all actions of assistants, second photographers, or subcontractors.




6. Artistic Style & Creative Control


6.1 Creative Discretion

By booking, Client acknowledges familiarity with our portfolio and grants us full creative discretion regarding lighting, posing, style, composition, editing, and artistic interpretation.


6.2 Retouching Requests

Requests for specific editing styles, retouching intensity, or visual aesthetics must be discussed prior to the session and agreed upon by both parties.




7. Retouching, Editing & Revisions


7.1 Standard Editing

All delivered images include color correction, exposure adjustments, and standard retouching.


7.2 Additional Retouching

Extensive edits (body reshaping, background reconstruction, object removal, advanced skin edits) will incur additional fees.


7.3 Client Alterations Prohibited

Client may not apply filters, AI enhancements, or edits of any kind to the final images without permission.




8. Image Delivery & Timelines


8.1 Proof Gallery

Preview gallery, if agreed upon by both parties, delivered within 1 week of the session date.


8.2 Final Deliverables

Final images delivered within 2 weeks after the proofing period, unless otherwise stated.


8.3 Rush Delivery

Available upon request for an additional fee.


8.4 File Storage

Galleries remain available for 12 months after the date of delivery. Archival storage beyond this period is not guaranteed and may incur additional fees to re-instate. If a gallery is expired past the 1 year mark it will no longer be available for online viewing. A $100 administrative fee will be charged to re-instate the gallery for online access.




9. Copyright & Usage Rights


9.1 Copyright Ownership

White Moth Studio retains full copyright to all images under U.S. Copyright Law.


9.2 Client License

Upon full payment, Client receives a perpetual, non-exclusive, non-transferable license for personal use or approved commercial use depending on the session type.


9.3 Prohibited Uses

Client may NOT:

  1. Sell, license, or redistribute the images
  2. Submit images to contests or publications without permission
  3. Train AI models using the images
  4. Alter, filter, or modify images
  5. Remove watermarks (if present)




10. Model Release & Marketing Use


10.1 Model Release

Client grants the Photographer permission to use images for promotional purposes, including website, portfolio, print marketing, and social media.


10.2 Opting Out of Promotional Use

If the Client wishes to opt out of promotional use, the request must be made in writing prior to the session.




11. Website Terms & Digital Content


11.1 Content

All content on the White Moth Studio website—including text, images, designs, and graphics—is protected by copyright.


11.2 Website Terms

You may not copy, screenshot, distribute, or reproduce website content without written permission.


11.3 Legal Action

Unauthorized use may result in legal action.




12. Limitation of Liability


12.1 Limited Liability

Our total liability for any claim, damage, or loss is limited to the total amount paid by the Client.


12.2 No Consequential Loss

We are not liable for:

  1. Lost profits
  2. Emotional distress
  3. Indirect or consequential damages
  4. Weather conditions
  5. Location restrictions
  6. Attendee behavior
  7. Acts of God or equipment failure
  8. Failure of online galleries or print labs


12.3 Liability Cap

If images are lost, corrupted, damaged, or destroyed before delivery, liability is limited to a refund of all payments made.




13. Force Majeure


We are not liable for delays or failure to perform caused by events outside our control, including natural disasters, pandemics, power outages, transportation issues, labor strikes, or technology failures.




14. Privacy Policy


We collect and store personal information necessary for booking, delivering services, and communicating with Clients. We do not sell personal data. Full Privacy Policy available upon request or on our website.




15. Governing Law


These Terms are governed by the laws of the State of Washington.

Any disputes will be handled exclusively in the courts of King County, WA, unless mutually agreed otherwise.




16. Amendments


We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
